Please read these Terms & Conditions carefully. By purchasing or downloading any digital product or service from Michelle Jones Creative LLC (“Company,” “we,” “us”), including but not limited to website themes, templates, checklists, worksheets, logos, graphics, media kits, business cards, moodboards, other digital files, domain registrations, or hosting plans (“Products and Services”), you agree to the following terms. If you do not agree, you may not use or access the Products and Services.
All Products are owned by Michelle Jones Creative LLC and protected by U.S. and international copyright laws. When you purchase a Product, you are granted a limited, non-transferable, non-exclusive license for personal or internal business use only. You may not resell, share, sublicense, or distribute the Product in any way without our written permission.

All website themes include a small footer credit linking to our site (“Design by M|J Creative” or “Michelle Jones Creative”). You agree not to edit or remove this credit. If you do, a $500 removal fee will apply.
When you purchase domain registration through us, the following terms apply:
Your hosting plan includes the storage, bandwidth, and server environment outlined at the time of purchase. Specific plan details, including any uptime expectations, are provided in your service agreement or purchase confirmation. We make reasonable efforts to maintain server availability but do not guarantee uninterrupted service and are not liable for downtime beyond our reasonable control.
Hosting services are billed on the cycle selected at purchase (monthly or annual). Payment is due at the start of each billing cycle. We reserve the right to suspend hosting access if payment is not received within 7 days of the due date.
If a hosting payment lapses, your account will be suspended. Suspended accounts will be held for up to 30 days, after which we reserve the right to permanently delete all associated files and data. We are not liable for any loss of content, data, or revenue resulting from suspension or termination due to non-payment.
We also reserve the right to suspend or terminate hosting for policy violations, resource abuse, or activity that violates applicable law.
We are not responsible for data loss under any circumstances. Clients are strongly encouraged to maintain their own independent backups of all website files, databases, and content. Any backup services we provide are offered as a courtesy and are not a substitute for your own backup practices.
You may cancel hosting services at any time. Monthly plans are non-refundable once a billing cycle has begun. Annual plans are non-refundable after 30 days from the start of the current term.
All sales are final. Due to the nature of digital products, downloadable files, and domain registrations, we do not offer refunds. Hosting refunds are governed by Section 4e above. You are responsible for full payment at the time of purchase.
Chargebacks will not be tolerated. If a chargeback is initiated, we reserve the right to report it to credit bureaus and collection agencies and to pursue legal remedies. The chargeback amount plus any associated fees must be repaid for resolution.
Purchased Products are delivered digitally. Printed materials are not included unless stated otherwise.
Themes include access to our support site, theme updates, and bug fixes caused by the original theme files. Support does not include customizations, plugin conflicts, or issues resulting from changes you or a third party make to the theme code or styling. Once a theme is retired, updates and support are no longer provided.
Hosting support covers server-side issues within our environment. It does not include WordPress errors, plugin conflicts, theme customizations, or issues introduced by third-party integrations or changes made by you or another developer.
If access to a digital portal is provided, you are responsible for keeping your login credentials confidential. Sharing login access is prohibited. We reserve the right to suspend or terminate accounts for suspected misuse.
Unauthorized use of our Products or Content is strictly prohibited. This includes distribution, resale, or use outside the license terms. Any such use constitutes infringement. You agree to pay liquidated damages of five (5) times the original purchase price or $5,000, whichever is greater, in addition to any legal remedies available to the Company.
If you share or submit content to us (e.g., testimonials, comments, images), you grant us an irrevocable, royalty-free license to use, publish, and adapt your contributions for marketing or product purposes, with or without identifying you. You confirm that you have the legal right to submit such content.
All trademarks, logos, and brand elements used within the Products or on our website are the property of Michelle Jones Creative LLC unless otherwise noted. Use of these marks without written permission is strictly prohibited.
You agree to indemnify and hold harmless Michelle Jones Creative LLC and its affiliates, contractors, and representatives from any claims, liabilities, or expenses arising from your use of the Products or Services in violation of these Terms.
Products and Services are provided “as is” without warranties of any kind. We do not guarantee that the Products will be error-free, compatible with all platforms, or meet your specific requirements.
We are not liable for any damages resulting from your use or inability to use the Products or Services, including but not limited to loss of revenue, business interruption, data loss, or domain expiration.
These Terms are governed by the laws of the State of North Carolina. Any disputes will be resolved in the courts located in Mecklenburg County, NC.
We may update these Terms at any time. Continued use of the Products or Services after changes are made constitutes your acceptance of the revised Terms.
